Did that months ago ! LTDA have copies of ALL the paperwork and I gave them authority to print EVERYTHING in my name.It may not help me but I did hope to warn others.I am no longer a member of the LTDA but I did hope they would work to warn and protect their members.

Dear Sir

I recently wrote to you regarding safety defects on the LTI TX4. I subsequently received a letter from the supplying Dealer, KPM, requesting that I attend a meeting with an LTI representative at their premises.

I agreed to this meeting thinking that it would be relative to the multitude of serious defects with my vehicle, but in reality their only interest was to condemn and criticise my complaint to VOSA.

My vehicle was road tested by Mr T Hattersley, at the end of which he pronounced, “Nothing wrong as far as I am concerned, it’s a Vehicle Characteristic”

He said, “I want to take it back to plant for Dis-assembly”

WHY IF THERE IS NO FAULT ? I REFUSED THIS REQUEST OUT RIGHT !

I pointed out the fact that nearly six months ago LTI (T Hattersley) took my vehicle back to plant for the same faults after agreeing that the faults were extensive, and after FOUR weeks returned it to me with the same faults stating that all faults were Inherent Characteristics of the vehicle !

I was told by T Hattersley that this was not relevant ! He also stated, “ We have won all court case that we have not been allowed to take the vehicle back and dismantle”, and said that he would report to VOSA that I had no interest in following up my complaint.

THIS IS NOT TRUE, HOW CAN VOSA ALLOW LTI TO INVESTIGATE AND DICTATE A COMPLAINT ABOUT VEHICLE SAFETY !

YOU ALREADY HAVE AN INDEPENDENT ENGINEERS REPORT (HE IS PREPARED TO ATTEND COURT) CONDEMNING THE VEHICLE, AND I AM PREPARED TO PAY FOR AN ENGINEER APPOINTED BY VOSA TO CONFIRM THE DISGRACEFUL CONDITION OF MY VEHICLE.

To add insult to injury T Hattersley made the comment “ You have not demonstrated a Duty of care to your passengers by continuing to drive a vehicle with defects, in the event of an accident you would face charges in court” Hypocrisy at its best !!

PLEASE ANSWER THESE QUESTIONS :

ARE YOU GOING TO ALLOW LTI TO LEAVE ME DRIVING THIS VEHICLE IN ITS PRESENT CONDITION ?

ARE YOU GOING TO ALLOW LTI TO ASSESS THEIR OWN PRODUCT AND COVER UP ITS INHERRANT DEFECTS PUTTING THE PUBLIC AT RISK

I CAN ONLY LIKEN THIS SITUATION TO ASKING A RAPIST OR A BURGULAR IF THEY BELIEVE THEY HAVE DONE ANY THING WRONG, THE ANSWER IS OBVIOUS !

VOSA has a duty of Care/safety to the Public and to me,YOU ARE allowing LTI to continue their catalogue of cover-ups.


Please respond with a sense of urgency, every day that I am forced to drive this vehicle leaves the public at risk.

Just had VOSA on the PHONE ! Despite our T Hattersley saying my vehicle is fault free but still wanting to take it back to plant,VOSA will shut the case unless I let LTI investigate their self !

They have declined my offer to pay for an independant Engineers report !

Looks like LTI have the system nicely in their pocket,Just leaves my Court case now.

Further to our meeting of November 22nd and subsequent road test of your vehicle registration number LA56 GPK LTI Vehicles take the opportunity of thanking you for your time.
During our meeting you declined the request to allow LTI Vehicles to carry out investigations into your reported concerns other than allowing us to road test the vehicle and carry out a visual inspection.
You stated that you would not allow any dismantling of the vehicle or connection of any diagnostic equipment until after the case has been heard by the court.
LTI Vehicles have had no alternative but to advise VOSA of your position.
You are however requested that due to you stating to VOSA in your report that your vehicle "is an accident waiting to happen" that you reconsider your stance and give us the opportunity to either validate your reported concerns and take the necessary action or refute your concerns giving valid reasons.
You are respectfully requested to confirm your decision in writing to the originator in 14 days.

I have read your story and also the details you have posted on your internet site.
I am shocked by the engineers report but am also amazed that the vehicle was not automatically replaced "in the interest of public safety".
The vehicle sounds like it a accident waiting to happen mate.
You are right..and no one should pull you to bits in any way shape or form.
You have rights mate and you seem to be dealing with the matter very professionally so I wish you all the best of luck.
If I had that amount of money in a vehicle and was experiencing the problems you are I would be no less than devastated.

Bexley 129 - I am surprised it has not been made clear to you (or am I?) that you are wading into very expensive deep waters. If you were an ordinary punter buying a car you would have more rights within the law to call upon, simply because you would not be expected to know the ins and outs of the law.

Whether you like it or not, you are a businessman who has bought a tool for his business i.e. your TX4. The law expects more of you and makes it much more difficult for you to win your case in court.

By law if you purchase goods or a vehicle which you find to be faulty, you have to give the manufacturer the opportunity to rectify the faults. This you may have to do on more than one occasion. Only when the manufacturer refuses to rectify the faults will you find yourself in a position to sue and win, but you would need written evidence stating that they were not prepared to rectify the faults.

From what you have posted I would be very surprised if you won, as it seems to me you are playing right into their hands by refusing to allow them to repair your vehicle.............................. I would strongly advise you to speak with your local trading standards officer.

I can fully understand your frustration with LTI and hope that you resolve this to your satisfaction, but I would tread very carefully bearing in mind lawyers get paid whether you win or lose. Best of luck!!

LTI have written to VOSA in an attempt to dis- credit my complaints.VOSA have phoned me regarding LTI comments.

My sole aim is to achieve a vehicle fit for purpose and worth £35000,or give me and all the others our money back.!

I have tonight received my 72nd e mail from a fellow sufferer,who unfortunately appears to have my vehicles TWIN !

Various comments have been posted refering to my actions against LTI and KPM,and my possible ignorance towards the consequences of my attempt to achieve justice.

I am spending my own money,I have tried all reasonable avenues to achieve a satisfactory conclusion,in the interests of my own situation and my fellow victims of LTI and KPM,I will follow this disgraceful scenario through to the courts where I hope WE may achieve JUSTICE.

I have explored virtually EVERY angle,but I am open to any constructive suggestions.

MY NAME IS PETER FOREMAN. IF CAB DRIVERS AND TRADE ORGANIZATIONS HAD STOOD TOGETHER IN THE PAST LTI WOULD NOT BE ABLE TO KICK US ALL IN THE TEETH NOW !

I need to make a few things clearer:

In law I have NO CONTRACT WITH LTI, my contract is with KPM the supplying dealer and The Bank Of Scotland my Finance providers.

My court action is against these parties for failing to supply me with goods as specified on purchase : "A VEHICLE FIT FOR PURPOSE AND OF MERCHANTABLE QUALITY".

While I may chose to communicate with LTI to achieve a satisfactory result,and give them a chance to act with a degree of responsibility,they will not be facing me in Court.

If my case is proved against KPM,they in turn are then able to issue Court proceedings against LTI.

We all know that if I am successful KPM will not do this,they are to busy kissing the back side of T Hattersley (LTI),after all they do not want to bite the hand that feeds them very nicely !

I have at no time refused a repair on my vehicle,I did refuse T Hattersley the right to take my "Vehicle back to plant", to carry out an inspection for VOSA.This was because the vehicle has already been back to plant for 4 weeks for EXACTLY the same faults and was returned to me with a statement that the faults were "Inherrant Characteristics".

Also T Hattersley smugly told me at our recent meeting after driving the vehicle "there is nothing wrong with this vehicle and that is what I will tell VOSA when it has been back to plant,VOSA RELY ON US FOR THE REPORT SO THIS WON`T BE GOING ANY FURTHER"

He was not interested in the other numerous faults eg severe gearbox dis- function,and treated me with total contempt.

However,my solicitor has today written to VOSA and LTI,KPM, and advised that the vehicle is available for inspection at the premises of KPM in my presence.If they are still insistant on taking the vehicle back to plant then it is requested that I am given a like for like loan vehicle ,and a written undertaking given that the vehicle will be returned in a fault free condition within a specified time.In the interim my Barrister will be filing for a Court date.

I am today instucting the largest Independant Vehicle Inspectors in England to carry out an in depth report on my vehicle.THIS WILL BE COMPLETED BEFORE LTI HAVE ACCESS TO THE VEHICLE ! Yes more money but I am 100% sure they will condemn the vehicle as the previous inspection did.This will obviously be used as evidence in Court and will be posted on the Internet.

I hope this clarifys these points,and would add for those of you who have suggested I contact the papers,this has already been done ! Not one paper has yet published,not even the LTDA.

I am now going to send a copy of EVERYTHING TO OUR MAYOR,KEN LIVINGSTONE,and will advise you of his response,if any!

(BRAKES/ACCELERATOR)THAT WILL BE THE END OF THIS MATTER"


CAN LTI STILL HIDE BEHIND THE BLATANT COVER UP OF SERIOUS FAULTS THAT A SECOND INDEPENDANT INSPECTION HAS CONFIRMED.THE INTEGRITY OF TREVOR HATTERSLEY, LTI,AND KPM ARE IN PIECES.IS LTIs CUSTOMER AND TECHNICAL SUPPORT MANAGER REALLY QUALIFIED TO ASSESS OBVIOUS MECHANICAL FAULTS WHEN HIS JUDGEMENT IS SERIOUSLY CONTRADICTED BY 2 MUCH MORE HIGHLY QUALIFIED INDEPENDANT SPECIALISTS.

Dear sir,

I note that you recently (30.11.07)met a representative from LTI and praised the New Generation TX4 in front of the Houses Of Parliament.It is all very well to admire a shiny new vehicle and be carried away by the "Hype" that LTI are Masters at portraying to the Press, and any other person who looks no further than the shiny paintwork,but the true reality is a million miles away from the truth.

I and hundreds of other owner drivers have seriously defective TX4s,LTI refuse to accept this fact and treat us with complete contempt.

On a personal basis my vehicle has been defective from day one,and despite LTI eventually recovering my vehicle back to the factory,and keeping it for 4 weeks,have yet to provide me with a vehicle "Fit for purpose".

LTI have described my vehicle faults as"Inherent Characteristics of the Design".(Letter available from LTI)

I have commissioned 2 Independent Vehicle Inspections and attach the most recent as a file to this e mail.

I trust you will take the time to read the truth and perhaps offer your suggestions,I also have in excess of 70 e mails from other owner drivers listing their faults,perhaps you would like to take the time to look at my Web Site where the Truth is printed

If you visit the above American site there is plenty of evidence about the gearbox used in the TX4 (Same as the Jeep Cherokee).

Chrysler GM have had transmission problems for decades,5 deaths are listed by gearbox mal-function,345 accidents by gearbox "self selection".

LTI have bought more "Bargain Basement" major components with out doing their research ! As I have stated before "The TX4 has serious Inherrant design faults"

And still LTDA mag and many others carry Adds for this vehicle, and evidently refuse to cover your story?. Doubt if they would have been able to do that had you maintained your membership of LTDA.

You are obviously being given the run around. good move contacting Ken, no doubt if he believes your story is being replicated he will get interested on a SAFETY basis.

I dont understand how PCO dont get more involved?

I wish the GMB could help! but we took the decision long ago NOT to admit Hack in london into membership.We wish you luck with this issue!
