one of my mates who's a ph driver was flagged down this morning near the town centre, its heavily rained up here today .and the public transport was running late due to flooded roads and in some cases not running at all.

 

my mate saw a man in his fifties soaking wet  about 10 yds from a bus stop that didnt have a shelter, the traffic was queuing and the oldish man hailed him as he was very driving slowly in 1st gear, almost crawling past this man.

 

he put his window down and asked him if he was lost etc but he said he needed a lift to the town centre, as he was soaking wet he let him in and low and behold its a gent from licensing etc and he's doing him for it. surely he trapped him ?  it must be entrapment etc and cant get done for it surely. what info should i pass on for him to defend himself,

i personally wouldnt of let him in as wouldnt of wanted my cab wet through especially the seats, as my regular fares wouldnt of appreciated it....lol

Definitely NOT entrapment. he new the law and it applies whether its raining or not! That said nice bastard the LO?

While not disagreeing that the law is the law, I would think that using compassion and human decency under extraordinary weather conditions might have some effect as mitigating factors.

Allo Allo unfortunately this driver would have been driving un-insured! and i dont think too many Hack drivers would have any sympathy?
