Hello.
Can I ask a couple of questions about legal issues please.
I have just began my own business from home in tyne and wear and I am been told mixed answers about the following.
I am a HAC plate licenced with a council outside my home council where I operate.
( This is only until my CRB is returned so I can re-plate with this council )
I have aquired a operator licence with my home village council so I can take private bookings.
Some tell me I need not of bothered as been a hac and only working my 1 car from my home it is not a requirement is this right ?
And also I was told ( again from other drivers in the trade ) I can only take bookings that go "To, from or through my operator licence council area" is this correct ?
Or can I take bookings wherever the caller requests ?
 I would just hate to break any minor rules as I was hoping to keep everything above board.

Steve,

Firstly can I just ask which authority you are now licensed with.

Secondly, I'll answer your questions ................ there is no requirement for you to have a operators licence as the HC licence you have allows you to take telephone bookings for your HC, this work you can pass onto OTHER HC vehicles BUT NOT TO ANY PH vehicles.
You can take a booking from wherever to wherever.

GA sorry if im wrong on this one, if a hack takes a phone booking outside his licensing area. and when he takes the booking on his radio / phone he's out of his licensing area is that not cross border hiring ? on the radio i dont think it is, but if the booking came over the phone [mobile] then surely thats a call to him taken outside his licensing area because when he answered the phone he was in another licensing area, ok i know he's a hack and not a ph but like most of us we give out our number to friends family etc. but surely it depends on where we are when a phone booking is taken ? on the other hand how would licensing prove we were out of our licensing area when we answered the mobile ?


i think cross bordering is a absolute pigs ear to fathom out and understand.

GA, I am pleased to hear that reply.
I was told that I could only give work to hacks and not PH vehicles if I did not get a op licence.
What was a little soul destroying is the fact that local councils did not point out the "1 car Hac rule" but insisted I would need an op licence to begin. In the time it took to come through I was finding it hard. But they never seemed to mention the other option to me.
I was also told that you need to have an op licence in any case if you advertise your business, like card drops / yellow pages etc:
And David I see where you are coming from to say depending where you are
on the map would detirmine the technical issues on this.

I hop[e my avitar does not offend anyone David ( Its only there for a laugh ) it however means "No dickheads" lol
But thanks lads for the advice . I appreciate it.

You can drop cards or otherwise advertise your business in any way you either see fit or can afford.

You should be able to advertise your company name and phone number somewhere on your vehicle.

The requirement of an operators licence could possibly be made clearer ................. so I will attempt to do so -

A Hackney Carriage Licence allows you to operate that Hackney Carriage, if you phone or contact another Hackney Carriage he (or she) also has a licence to operate the Hackney Carriage they drive and so no further licence is required.

We now have 3 Hackney Carriage "offices", 1 of those being a co-operative of Hackney Carriage drivers and the other 2 being individuals who seek telephone bookings and distribute that work amongst other Hackney Carriage drivers who in turn pay a weekly fee. None of these require a separate licence ...................................... indeed there is no requirement at all for any agent to be licensed to accept bookings provided the only vehicles used are Hackney Carriage.

PS: Has any one got a contract they want to farm out to me. ?
100% reliable, I will not let you down.
I know I am a cheeky t*at asking but I am desperate for one as my regular one has just ended.
